Introduction

Freezer Alert Pro™ is a product operated by Advanced Electronic Applications, Inc.™ ("Company", "we", "us", or "our").

We respect your privacy and are committed to protecting the personal information that you provide when using the Freezer Alert Pro™ application and related services. This Privacy Policy explains what data we collect today, how it is used, and how we safeguard it.

1. Information We Collect

Data from your Freezer Alert Pro™ device. The app communicates with your wirelessly connected Freezer Alert Pro™ device(s). Data exchanged between the application and the device(s) includes, for example:

  • Freezer temperature
  • Door or lid status (open/closed)
  • User-configured alert settings

This operational data is stored locally on your device unless you turn on optional features that require sending information elsewhere (such as SMS alerts or, if you use them, account or cloud features).

SMS Communications / Freezer Alert Pro™ Alerts SMS Program

If you choose to enable SMS alerts within the Freezer Alert Pro™ application, you consent to receive transactional text messages from Advanced Electronic Applications, Inc.™ related to your use of Freezer Alert Pro™. These messages may include one-time passcodes for verification, freezer monitoring alerts, temperature threshold alerts, power-loss alerts, door or lid open alerts, device status notifications, and important account or service-related notices.

Message frequency varies based on device conditions, alert settings, and account activity. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP or contact support@freezeralertpro.com.

SMS Privacy Disclosure: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with vendors, platform providers, telecommunications providers, or other service providers that assist us in delivering the text messaging service.

Your phone number is used solely to provide the requested SMS alert service and related account/security notifications.

Account, cloud, or payment data. If you use features that create an account, use cloud services, or make purchases, we may collect identifiers and related data needed to provide those features (for example, email, account ID, or payment information processed by payment providers). The app will show what is collected when you use those features.

2. How We Use Your Information

We use operational data to provide monitoring and alerting on your device.

If you enable SMS alerts, we use your mobile number only to send the transactional messages described above. We do not use your phone number or SMS opt-in for marketing or promotional purposes.

If we introduce new features that collect additional personal information, we will describe that use in an updated Privacy Policy and obtain consent where required by law.

3. Data Sharing and Disclosure

We do not sell or rent personal information. We do not share personal information with third parties or affiliates for their marketing or promotional purposes.

Phone numbers and SMS opt-in data are treated as described in the SMS Privacy Disclosure in Section 1 (including sharing only with service providers necessary to deliver the text messaging service).

We may disclose information when required by law or with your explicit consent. We may use anonymized or aggregated data that cannot reasonably identify you for analytics and service improvement.

4. User Consent

Creating an account or accepting our Terms or this Privacy Policy does not enroll you in SMS alerts by itself. SMS consent is separate: you provide it when you affirmatively enable SMS alerts in the application. You can withdraw SMS consent by replying STOP or by turning off SMS alerts where the app provides that control.

5. Security of Your Information

Operational data is stored locally on your device unless you use optional services that require transmission. Where we process personal information (for example, for SMS delivery or account features), we use reasonable administrative, technical, and organizational safeguards appropriate to the data involved.

6. Your Rights

Depending on your location and the features you use, you may have rights to access, correct, or delete certain personal information, or to opt out of certain processing. Contact us at the address below for requests. You can opt out of SMS as described in Section 1.

7. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through the app or other appropriate means, and we will update the Last updated date at the top of this policy.

8. Severability

If any provision of this Privacy Policy is held to be invalid, illegal, or unenforceable by a court or other authority of competent jurisdiction, the remaining provisions shall remain in full force and effect.

9. Governing Law, Arbitration, Jury Waiver, and Class Action Waiver

This Privacy Policy shall be governed by the laws of the State of Montana, U.S.A., excluding its conflict of law principles.

Any dispute arising out of or relating to this Privacy Policy or the Freezer Alert Pro™ application and services shall be resolved exclusively by binding arbitration in Bozeman, Montana, U.S.A., administered by the American Arbitration Association under its Commercial Arbitration Rules, except where prohibited by law. The arbitration shall be conducted on an individual basis only; you waive any right to participate in a class action lawsuit or class-wide arbitration.

If the arbitration agreement in this section is held to be void or unenforceable for any reason, any litigation between you and us shall be brought exclusively in the state or federal courts located in the State of Montana, and you agree to waive any right to a jury trial.
